    Primary vs. Secondary Exemption All Wayne County Residential Owners: Are you receiving the primary exemption on your home? If, so, there is a 45% taxable difference if your home qualifies. The easiest way to check for yourself is to see if there is a difference on your recent tax notice between the Market Value and the Taxable Value. This exemption is the owner’s responsibility to claim and provide all necessary paperwork. You are welcome to call or stop by the Assessor’s office at 435-836-1305 or 435-836-1306 and we will be happy to check our records for you.

    General Information: Form PT-23 needs to be filled out at the Assessor’s Office when you apply for the primary exemption. Please provide the drivers licenses of each owner showing your current physical address, plus you will need to provide 2 additional forms of evidence proving your physical address. The home MUST be occupied by you, or a tenant, for 183 or more consecutive calendar days in a calendar year. There are additional requirements on the Utah State form PT-23-our office just administers it.

Friday’s The DMV Office will continue to be closed due to Appraisal Field Work. During the 2025 year, we will be appraising all homes in the Loa, Lyman, and Bicknell areas. Some Friday’s may be needed for data entry and processing, but will still be considered necessary field work days.

Please visit our DMV office Monday – Thursday and we will be happy to help you with your motor vehicle needs. If you need assistance on Friday’s during our DMV office closure, there are on-the-spot registration locations available at Brian Auto – Loa and M&D Auto – Bicknell.

Attorney’s Office

Wayne County’s attorney is the county’s chief legal officer, and is responsible for providing legal services and legal advice to the county’s elected officials, county government employees, and various County Boards.

The county attorney is the county’s chief prosecutor, and responsible for prosecuting individuals who commit any public offense proscribed under state statutes or local ordinances.

The county attorney prosecutes offenses on behalf of the State of Utah, including both misdemeanors and felonies. In addition to prosecution, the county attorney is responsible for providing legal representation for the county in civil matters.

Birth & Death Certificates

Obtaining Certified Copies\ Some birth and death records from 1898-1959 are available at the Clerk/Auditor’s Office located at 18 S Main Street. Anything after 1959 is available through the Central Utah Public Health Department’s Office of Vital Records and Statistics.

Marriage Licenses

Requesting Certified Copies\ Marriage licenses are classified as a vital record, and can only be provided to an applicant who demonstrates “a direct, tangible, and legitimate interest”(Utah Code, 26-2-22) in a vital record.

 To apply in person (or by mail): Contact the Clerk’s Office.\ \ Purchase a new Marriage License The couple must do the following:

Download and complete the Marriage Application Worksheet.

Come to the Wayne County Clerk/Auditor’s Office together Monday - Friday between 8:30am - 4pm.  (Closed Holidays)  

Provide identification and proof of age (driver’s license, passport, etc.). 

Pay a non-refundable fee of $40.  The fee includes one certified copy.

Additional Information

  • Marriage licenses are valid 30 days from the date of purchase.  Refunds and extensions cannot be granted.
  • A marriage license issued in Wayne County may be used anywhere in the state of Utah.
  • Applicants must be at least 18 years of age, or follow the procedures below. 
  • Applicants aged 16 and 17 years must provide a certified birth certificate, have parental consent, AND written authorization from a judge of the court exercising juvenile jurisdiction in the county where either party resides to be married. A parent or legal guardian must give sworn consent in-person at the time of application, and must have proper identification. If the parents of the minor are divorced, consent shall be given by the parent having legal custody of the minor or, in cases where joint custody has been awarded, the parent having physical custody of the minor the majority of the time. If the minor is not in custody of a parent, the legal guardian shall provide the consent and shall provide proof of guardianship by court order.  
  • Applicants aged 15 years or under cannot obtain a marriage license under current Utah law.
  • First cousins may marry if they are 65 years of age or older. If they are between 55 and 64 years of age, the district court in the county where they reside must find that either person is incapable of reproduction in order for them to be married.  
  • Any persons related to each other within, but not including the fifth degree of consanguinity, except for cousins as stated above, may not be married.

Passports

The Application Process: Passport applications can be accepted in the Wayne County Clerk/Auditor’s Office 8:30 am to 4 pm, Monday through Friday. The Clerk/Auditor’s Office does not issue the passport; the completed application, fees, and all documents are sent to the U.S. Passport Agency for processing. \ \ Application Requirements

  • Applicable fees (A check, money order or cash
  • Both parents for children age 16 and under
  • One passport-quality picture
  • Proof of U.S. citizenship (old passport or certified birth certificate)
  • Picture identification (driver’s license)
