Wayne County Road Department Encroachment Permit Application Process 

Wayne County Road Department policy requires an encroachment permit before any construction or maintenance activity takes place that involves entering onto or leaving established Wayne County roads.

*Once approved, paid for, and issued, the Wayne County Road Encroachment Permit will remain active for a period of 90 days.

  • Wayne County Road Department policy prohibits digging or excavating within the county road right of way (66’, 33’ from road centerline) to place, construct, or maintain any approach road, driveway, pole, pipeline, conduit sewer, ditch culvert, billboard advertising sign or any other structure or object of any other kind without obtaining an encroachment permit.

  • Restoration of surface by permittee. 

    Immediately upon completion of the backfilling, temporary resurfacing of an excavation on Wayne County roads for the installation or removal of substructures must be completed. The Wayne County  Road Department requires the permittee to permanently resurface that portion of the street surface damaged by the permittee’s excavation, in which event resurfacing shall be of the same type and depth of existing pavement, asphalt shall not be less than two (21/2) inches in thickness and shall be subject to the inspection of the Wayne County  Road Department, and shall be completed within a period of fourteen (14) days except where temporary resurfacing is placed or weather conditions do not permit immediate placement of permanent pavement.

  • As part of the encroachment application process be prepared to provide a detailed plan of work in PDF format, a drawing and or map of proposed encroachment area, property description, parcel # and construction contractor (if used.)

  • The Wayne County Road Department Encroachment permit application is to be completed and signed by the private property owner or their agent / representative and construction contractor.
